Building Permit Exemptions

International Residential Code for Single-Family Construction

  • One-story detached accessory structures used as tool and storage sheds, playhouses and similar non-habitable space, provided the floor area does not exceed 120 square feet
    • Zoning requirements apply (e.g.-height, setbacks - EMC 18.06)
  • Fences 6 feet or less in height
    • Fences must meet the requirements of EMC 18.06.110
  • Retaining walls 4 feet or less in height, as measured from the bottom of the footing to the top of the wall
    • This exemption does not apply to retaining walls supporting a surcharge
    • Walls must still meet the requirements of EMC 18.06.110
  • Water tanks supported directly upon grade if the capacity does not exceed 5,000 gallons and the ratio of height to diameter (width) does not exceed 2:1
  • Sidewalks, patios and driveways (may require a permit from Public Works)
  • Painting, papering, tiling, carpeting, cabinets, countertops, and similar finish work
  • Prefabricated swimming pools that are less than 24 inches deep
  • Swings and other playground equipment accessory to detached 1 - and 2 - family dwellings
  • Window awning supported by an exterior wall which project 54 inches (4.5 feet) or less from the exterior wall and do not require additional support
  • Decks not exceeding 200 square feet in area, that are not more than 30 inches above grade at any point, are not attached to the dwelling and that do not serve an exit door which is required by IRC Section R311.4
